Cluster Hosting Environment

To maintain stability and performance across the cluster, we may apply resource controls or take corrective action if an account’s usage affects overall system reliability.

Right to Modify or Restrict Services

We may limit, suspend, or adjust service resources to protect system integrity, prevent abuse, or comply with legal obligations.

No Guarantee of Unlimited Resources

“Unlimited” features (where applicable) are subject to fair‑use policies and technical limitations.

Acceptable Use Policy (AUP)

You agree not to use hosting services for any unlawful, harmful, abusive, or disruptive activities.

Prohibited Content & Activities

• Illegal, harmful, or abusive content
• Hacking tools, malware, phishing
• Pirated or copyright‑infringing material
• High‑risk financial schemes
• Hate, harassment, extremist content
• Proxy scripts or mass‑file‑sharing systems
• Cryptocurrency mining
• IRC bots, P2P clients, torrent services
• Long‑running or unattended server processes
• Excessive resource usage impacting stability

Email Usage Restrictions

• No unsolicited email (spam)
• No automated email sending without proper configuration
• No sending from invalid or misconfigured addresses
• No sending to large numbers of invalid recipients
• No malicious or infected email content

Violations may result in suspension or termination.

Resource Usage Limits

CPU, Memory & Disk Usage

• No single account may use more than 25% of system resources for more than 90 seconds
• No more than 100,000 files on shared hosting
• No database query may run longer than 15 seconds
• No more than 50% of hosting disk space may be used for email storage
• Email storage may not exceed 10 GB per hosting account

Bandwidth Usage

Bandwidth is unmetered under fair‑use guidelines. Excessive usage may require an upgrade.

Sensitive Data Disclaimer

Hosting services are not compliant with medical‑data regulations. You may not store or process medical records, protected health information, or regulated sensitive personal data. Storing such data is a material breach and grounds for termination.

Backups & Data Responsibility

Customer Responsibility

You are fully responsible for maintaining your own backups of website files, databases, emails, and documents.

Provider Backups

We may perform periodic backups for disaster‑recovery purposes, but backups are not guaranteed, may not include email data, and should not be relied upon as your primary backup solution. Fees may apply for restoration.

Service Availability & Risk

Your use of hosting services is at your own risk. We are not responsible for data loss, service interruptions, security breaches caused by customer actions, or downtime caused by third‑party software.

Suspension & Termination

We may suspend or terminate hosting services if you violate this Agreement, threaten server stability, engage in illegal activity, or fail to pay for services. Suspension or termination does not relieve you of outstanding payment obligations.

Liability Limitation

To the fullest extent permitted by law:

• MIDI Web Design is not liable for indirect, incidental, or consequential damages
• Total liability is limited to the amount paid for hosting services in the previous 12 months
• We are not responsible for customer‑installed software, scripts, or third‑party integrations

Changes to This Agreement

We may update these Terms at any time. Changes take effect immediately upon posting. Continued use of hosting services constitutes acceptance of updated terms.
